Service Terms and Conditions

Luminex Smart Blinds Inc. (“Smart Blind Shop”) Terms and Conditions

Deposit Requirement
Upon placing an order with Luminex Smart Blinds Inc. (“Smart Blind Shop”), a deposit of 50% or an amount otherwise agreed upon is required to initiate the production of custom blinds.

Deposit Acceptance and Refund Policy
The deposit confirms the commencement of production for custom window coverings.
Customers may request a refund of the deposit within 12 hours of payment. Refund requests must be made by contacting our customer service team directly by phone.
A service fee of 5% of the deposit amount will be deducted from any approved refund.

Non-Refundable Conditions
No refunds will be issued for deposits after the 12-hour period has lapsed.
Deposits for emergency or fast delivery orders are non-refundable under any circumstances.

Final Payment and Taxation
The remaining balance of the payment is due on the same day the custom window coverings are installed and the final installation is complete.
A Goods and Services Tax (GST) of 5% will be added to the final invoice total.

Limitation of Liability
Luminex Smart Blinds Inc. (“Smart Blind Shop”) is not liable for any indirect, incidental, or consequential damages arising out of or related to the installation or use of the custom window coverings.
Our liability is limited to the cost of the product and installation services provided.
Smart Blind Shop is not responsible for damages resulting from improper use or failure to follow product instructions.

Fraud Prevention
Smart Blind Shop reserves the right to cancel any order that we believe is placed fraudulently or with misleading information.
Customers are required to provide accurate and truthful information when placing an order.
Any attempt to defraud or provide false information will result in legal action and forfeiture of the deposit.

Privacy Policy
Smart Blind Shop respects customer privacy and handles all personal information in accordance with our Privacy Policy.
Customer data is collected for the purpose of processing orders, providing services, and improving customer experience.
Personal information will not be shared with third parties without customer consent, except as required by law.

Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Province of British Columbia, without regard to its conflict of law provisions.
Any disputes arising out of these terms will be resolved in the courts of British Columbia.

Changes to Terms and Conditions
Smart Blind Shop reserves the right to update or modify these terms and conditions at any time without prior notice.
The updated terms will apply to any orders placed after the date of the change.

Installation and Measurement Accuracy
Customers are responsible for ensuring that all window details provided are accurate. Any errors may result in additional charges or the need for reordering at the customer’s expense.
Smart Blind Shop offers professional measurement services, and customers are encouraged to use this service to ensure accuracy.

Force Majeure
Smart Blind Shop is not liable for any delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to shipping delays in raw materials, machinery breakdowns, natural disasters, acts of war, government restrictions, or labor issues.

Customer Responsibilities
The customer agrees to provide access to the property for installation at the agreed-upon time. Failure to do so may result in additional charges.
The customer is responsible for preparing the installation area, including removing any obstructions and ensuring the area is safe for our installers.

Entire Agreement
These terms and conditions, along with any written agreements or invoices, constitute the entire agreement between the customer and Smart Blind Shop, superseding any prior agreements or understandings.

Limited 5 Year Warranty for Window Coverings

Coverage and Terms:
Luminex Smart Blinds Inc. (“we” or “our”) warrants that our window coverings, including blinds, shades, curtains, and any other window treatment products (“Products”), will be free from defects in materials and workmanship for the 5 year lifetime of the original purchaser (“you” or “your”). This limited 5 Year warranty is non-transferable and only applies to Products purchased from authorized retailers or directly from Smart Blind Shop. Proof of purchase is required to make a warranty claim.

Warranty Coverage:
During the 5 year lifetimeof the original purchaser, Luminex Smart Blinds Inc. will repair or replace, at our discretion, any defective Product, provided that the defect is due to faulty materials or workmanship. The warranty covers issues related to the functionality or manufacturing defects of the Products, including but not limited to defects in cords, hardware, and mechanisms.

Exclusions:
This limited 5 Year warranty does not cover damages or defects caused by:

– Normal wear and tear, including fading, discoloration, and fabric fraying over time.

– Misuse, negligence, accidents, abuse, or improper installation or operation of the Products.

– Modifications or alterations to the Products not authorized by Smart Blind Shop.

– Exposure to extreme environmental conditions, including excessive heat, humidity, or direct sunlight.

– Damage caused by pets or other animals.

– Acts of nature, such as fire, flood, earthquake, or other disasters.

– Installation or removal costs.

– Motors and motor parts have an expected lifetime of 5 years. Replacement after 5 years will be at the current part cost.

Warranty Conditions:

Maintenance: The Product must be properly maintained as per the care and maintenance instructions provided by Smart Blind Shop.

Non-Transferable: This warranty is non-transferable and only applies to the original purchaser and the property where the Product is permanently installed.

Alterations and Modifications: Any alterations or modifications to the Product that are not explicitly authorized by Smart Blind Shop will void this warranty.

Customer Measurement Responsibility: The Company relies on the customer’s accurate measurement to 1/8 of an inch for the Product’s dimensions. Any discrepancies due to incorrect measurements will not be covered under this warranty.

Removal and Reinstallation: The Product is intended to be a permanent fixture at the original installation location. Removal and reinstallation of the Product in a different location will void this warranty.

Making a Warranty Claim:
In the event that you believe your Product is covered under this limited 5 year warranty, please follow these steps:

Contact Smart Blind Shop through our customer service department at CustomerService@SmartBlindsShop.com to initiate your warranty claim. Provide your proof of purchase and a detailed description of the issue you are experiencing.

We may request photos or physical samples of the Product to assess the defect and determine the appropriate course of action.

If your warranty claim is approved, we will, at our discretion, either repair or replace the defective Product. If the exact Product is no longer available, we may replace it with a comparable Product of equal or higher value.

A service fees of $150 will be charged for in-house visit to assess the defected product covered under this limited warranty. Service fees is waived if the requets is made within 1 year of installation.

Limitation of Liability:
This limited warranty is the sole and exclusive remedy for any defect or issue with the Products. Smart Blind Shop shall not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use the Products covered under this warranty.

Applicable Law:
This limited warranty shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the Product was purchased.

Severability:
If any provision of this limited warranty is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By keeping and using the Product beyond the return period or by making a warranty claim, you acknowledge that you have read and understood the terms of this limited warranty and agree to be bound by them.


Customer Acknowledgment
By paying the deposit, the customer acknowledges and agrees to these terms and conditions.
